Abdul Ghafoor v. Sakhawat Khan,

PCrLJ 2012 1583 · Balochistan High Court

This case involved a criminal matter where the accused, Abdul Ghafoor and another, had reportedly reached a compromise with the family of a deceased victim over an offense involving injury or death under Pakistan's Penal Code (relating to Qisas and Diyat, the Islamic law concepts of retribution and compensation). The major heirs of the victim had waived their right to Qisas (retributive punishment), but the case involved minor heirs too, who needed compensation in the form of Diyat.

The accused asked the trial court to let them pay the Diyat amount owed to the minor heirs in the form of land rather than cash. The trial court rejected this request and instead ordered that the Diyat amount simply be deposited in a bank account for the minors, without ever formally deciding whether to accept the compromise, without fixing the actual Diyat amount, and without specifying each minor heir's share.

The Balochistan High Court found this was legally improper. It ruled that a trial court cannot just assume an automatic acquittal once a compromise is submitted; it must first examine the merits of the case and formally decide whether to accept or reject the compromise. Only after that should it determine the actual Diyat amount and how it should be paid. Since the trial court skipped these essential steps, the High Court set aside its orders and sent the case back, directing the trial court to follow the correct legal procedure this time.
