Samiullah and another V. The State and another,

PCrLJ 2012 1572 · Balochistan High Court

This case from the Balochistan High Court involved two related appeals concerning a large narcotics seizure. Anti-Narcotics Force officials intercepted a truck carrying 490 kilograms of charas hidden in secret cavities in the floor. The truck's driver, Samiullah, was convicted by the trial court and sentenced to life imprisonment plus a fine, while his father, Haji Nasrullah, who was sitting beside him, was acquitted. Samiullah appealed his conviction, and the State separately appealed against Nasrullah's acquittal.

The High Court dismissed Samiullah's appeal, finding the prosecution's evidence solid and consistent, with no meaningful contradictions from witnesses despite thorough cross-examination. It rejected his defense that he had been falsely implicated, calling it an afterthought to hide guilt, especially since the narcotics were found directly under his control in the truck he was driving.

However, the court also dismissed the State's appeal against Nasrullah's acquittal. It reasoned that merely sitting in the truck was not enough to prove guilt without evidence of conspiracy or knowledge of the hidden drugs. Since the narcotics were concealed from view, and no specific evidence linked Nasrullah to knowledge or control of them, his acquittal was upheld.

This case highlights an important legal principle: criminal liability requires proof of individual involvement, not just presence at the scene. The court emphasized that it is better to risk acquitting a guilty person than wrongly convicting an innoc
