Khadim Hussain v the State,

PCrLJ 2012 1477 · Balochistan High Court

This case involved two men, Khadim Hussain and Ghulam Sarwar, who were accused of murdering Juma Khan and Mst. Bakhtawar in Quetta in 2006, allegedly on the pretext of siyahkari, meaning suspected illicit relations, often described as an honour killing. They were charged under Section 302 (murder) read with Section 34 of the Pakistan Penal Code. A trial court had earlier refused them bail. They then approached the Balochistan High Court, arguing that the families of the victims had forgiven them and reached a compromise outside court, so they should be granted bail.

The High Court rejected this argument and refused bail. It held that no one has the right to take the law into their own hands and kill people in the name of honour or ghairat, calling such killings un-Islamic, illegal, and unconstitutional, violating the right to life protected under Article 9 of the Constitution, with customs justifying such killings being void under Article 8(1). The court clarified that while such offences can sometimes be compounded, any compromise is not automatically valid just because families agree privately outside court; it must be formally sanctioned by a court, which retains discretion to refuse it based on the case's circumstances. Since the accused were named in a promptly filed FIR, had been absconders, and were involved in taking two lives under the guise of honour, they did not qualify for bail.

This judgment matters because it firmly rejects honour as a legal justification for murder and limits misuse of private compromises to escape prosecution.
