Ehsanullah v. State,

PCrLJ 2012 1431 · Balochistan High Court

This case involved two brothers, Ehsanullah and Khairullah, who sought bail from the Balochistan High Court after being arrested in Gwadar. Police, acting on a tip about planned target killings and terrorist activity, raided the house where they lived and, based on their alleged pointing out, recovered hand grenades, 36 detonators, and time pencils from a guest room, along with a revolver and cartridges linked to a co-accused. They were charged under the Explosive Substances Act, the Anti-Terrorism Act, and the Arms Ordinance for possessing illegal weapons and explosives.

Their lawyer argued for bail on two grounds: that police failed to follow proper search procedures under Section 103 of the Criminal Procedure Code (which requires independent witnesses during searches), and that both applicants were minors, who are typically treated more leniently in criminal cases.

The court rejected these arguments and denied bail. It held that being a minor does not automatically entitle someone to bail in serious offences, and that each case must be judged on its own facts. It also noted that questions about the applicants' actual ages and whether search procedures were properly followed were issues for the trial court to sort out later, not at the bail stage. Since the offences were extremely serious and fell within the category of crimes where bail is generally restricted, and since there was sufficient evidence linking the applicants to the case, bail was refused. The court ordered the trial to be completed quickly, within three months.
