Ghous Bakhsh and others V. The State,

PCrLJ 2012 1308 · Balochistan High Court

Ghous Bakhsh had been convicted in three separate trials before the Sessions Judge, Kalat Division at Mastung, arising from three different FIRs involving separate incidents: an attempted motorcycle snatching with firing, a daylight robbery in which shepherds were tied up and 250 sheep stolen, and a firing incident that injured a man. He received different sentences in each case, including under sections dealing with attempted robbery, robbery, and causing hurt.

On appeal, his lawyer argued that under Section 35 of the Criminal Procedure Code, the sentences should run concurrently rather than one after another, since this would reduce his overall time in prison.

The Balochistan High Court rejected this argument. It explained that Section 35 only allows concurrent sentences when a person is convicted of multiple offences in a single trial. Since Ghous Bakhsh was convicted in three separate trials for distinct crimes committed at different times against different victims, this provision did not apply. The court distinguished this from Section 397, which deals with sentences imposed in different trials, and noted that even under its inherent powers, it could not order concurrent sentences for unrelated offences committed at different times.

The court also emphasized that sentencing serves both to deter crime and reform offenders, and must be neither too harsh nor too lenient. Since the appellant had already received minimum sentences and credit for time served, his appeals were dismissed as without merit.
