PCrLJ 2012 1228 · Balochistan High Court

This case concerns a lawyer who stood as a surety, on humanitarian grounds, for an alien accused facing minor charges under the Foreigners Act and Foreigners Order for issues related to his registration documents. When that accused later jumped bail and could not be produced, the trial court ordered forfeiture of the entire surety amount of Rs.40,000, and this order was upheld on revision by the Sessions Judge. The surety then approached the Balochistan High Court through a constitutional petition, seeking to have the forfeiture set aside or reduced.

The High Court held that standing surety for someone, especially a foreigner with no local connections, is an act of generosity and should not be punished harshly unless there is clear evidence that the surety acted with an ulterior motive or helped the accused escape. Courts must balance fairness with deterrence: sureties for serious crimes like murder, kidnapping, or terrorism deserve strict treatment, but those involved with minor offences should be treated leniently, since undue severity could discourage people from ever standing bail for others.

Finding no evidence that the surety had colluded with the absconding accused, and noting the accused's offence was minor, the court reduced the forfeited amount from Rs.40,000 to Rs.20,000. The judgment is significant because it sets out guidelines on how courts should decide the extent of forfeiture of bail bonds, distinguishing between serious and minor offences.
