Faiz Muhammad Jaffar v. the State,

PCrLJ 2012 1207 · Balochistan High Court

This case involved corruption charges under Pakistan's National Accountability Ordinance, 1999, relating to a government procurement scheme where tenders were called for supplying school materials like furniture and books under a World Bank-assisted education project. A contracting firm was allegedly awarded contracts despite quoting higher rates than competitors, and payments were made based on fake receipts even though goods were never actually supplied to schools. Officials were accused of accepting bribes or commissions in exchange for releasing payments to the contractor.

The trial court convicted three accused persons—Faiz Muhammad Jaffar, Sikandar, and Muhammad Rasheed Anjum—sentencing them to varying prison terms and heavy fines. They appealed, arguing that the witnesses who paid commissions were themselves complicit in illegality and thus untrustworthy accomplices.

The Balochistan High Court rejected this defense, holding that the witnesses had been forced to pay commissions only because officials withheld payment otherwise, so they weren't willing accomplices. The court also explained that once bribery is alleged, the burden shifts to the accused to prove any payment was legitimate remuneration—a burden the appellants failed to meet.

The court upheld the convictions and fines but reduced the prison sentences to time already served. It also clarified that if a convicted person dies, their fine can still be recovered from their estate, since criminal liability ends with death but financial liability does not. This case reinforces how corruption cases involving public funds are evaluated and how accountability continues even
