Jangi Khan v. The State,

PCrLJ 2012 109 · Balochistan High Court

This case involved two men, a bus driver and conductor, who were convicted for possessing and smuggling a massive quantity of opium, roughly 298 kilograms, found hidden in secret cavities of their bus. The Anti-Narcotics Force intercepted the bus near Quetta based on prior intelligence, and during questioning the two men pointed out the hidden compartments where the drugs were concealed. A third person allegedly involved managed to escape. The trial court convicted both men under the Control of Narcotic Substances Act, sentencing them to life imprisonment and fines, and they appealed to the Balochistan High Court arguing they had no knowledge of the hidden narcotics and that the bus itself was never produced as evidence at trial.

The High Court upheld the conviction. It ruled that information given by the accused leading directly to the recovery of the drugs can legally be used against them under Article 40 of the Qanun-e-Shahadat Order. Since the men were driver and conductor of the bus, the court said they had a duty to explain convincingly why they wouldn't have known about the hidden compartments, especially since they never testified under oath or presented any defense witnesses. The court also held that not physically producing the bus in court didn't hurt the prosecution's case, since the accused had already admitted being present in the bus and that drugs were recovered from it.

This case matters because it clarifies that being in control or possession of a vehicle carrying concealed narcotics can create criminal liability, even without ownership, and that courts prioritize the substance of evidence over procedural techn

ہائی کورٹ نے سزا کو برقرار رکھا۔ عدالت نے قرار دیا کہ ملز
