Zaffar V. The State,

PCrLJ 2012 1068 · Balochistan High Court

This case involved a man named Zaffar who was convicted by a Sessions Judge for the murder (qatl-e-amd) of a person named Aqeel and sentenced to life imprisonment along with a fine to be paid to the deceased's family. He appealed this conviction to the Balochistan High Court.

The prosecution had no eyewitness to the killing and relied entirely on circumstantial evidence: a judicial confession by the accused, an axe allegedly recovered based on his disclosure, and the fact that the victim's body was found near or connected to the accused's location. However, the High Court found serious problems with this evidence. The confession appeared to have been obtained through torture rather than given voluntarily. Witnesses last saw the deceased with a co-accused, not with Zaffar himself. The blood-stained axe was sent for forensic testing after an unexplained one-and-a-half month delay, and even the lab report did not confirm the blood matched the victim's blood group. The court noted that recovery of a weapon is only supporting evidence and cannot by itself justify a conviction without stronger direct proof. Similarly, merely finding the body near the accused's house did not prove he committed the murder.

Given these gaps, the court held that the prosecution failed to prove guilt beyond reasonable doubt, emphasizing that any doubt must benefit the accused. As a result, Zaffar was acquitted. The case highlights how convictions cannot rest on weak, delayed, or coerced evidence, reinforcing the fundamental principle that guilt must be established
