Tor Jan alias Jag V. The State,

PCrLJ 2012 1028 · Balochistan High Court

This case involved a man named Tor Jan, who was convicted by a trial court in Killa Abdullah and sentenced to life imprisonment for allegedly kidnapping his neighbor's sister, Bibi Rabia, who was later found dead with gunshot wounds. The prosecution claimed he broke into the family's house at night and abducted the woman, whose body was eventually found and identified in Afghanistan.

The Balochistan High Court overturned the conviction and acquitted Tor Jan. The judges found serious flaws in the prosecution's case: the FIR was filed thirteen days after the incident with no explanation for the delay, despite the police station being only four kilometers away. The witnesses were all closely related to the complainant and had personal animosity toward the accused. Since the abduction allegedly happened at night in darkness, the court doubted the witnesses could reliably identify the culprit. No medical or official documents were produced to prove how the woman died. The trial court's own reasoning was contradictory, first saying death by shooting wasn't proven, then treating it as proven anyway.

The High Court emphasized that in criminal cases, the prosecution must prove guilt beyond doubt, and any reasonable doubt must benefit the accused as a matter of right, not favor. This case matters because it reinforces important legal safeguards: unexplained delays in reporting crimes, biased witnesses, and weak evidence cannot justify a conviction, protecting individuals from wrongful punishment based on suspicion rather than solid proof.
