Noorullah Khan V. Sher Muhammad and 5 others,
PCrLJ 2011 67 · Balochistan High Court
This case is about a robbery complaint that resulted in acquittal of the accused, and the complainant's attempt to challenge that acquittal in the High Court.
The complainant, Noorullah Khan, alleged that on 23rd December 2008, Haji Zarif Khan and his sons, armed with weapons, stopped his vehicle, robbed him of Rs. 65,000, and threatened him against filing a police report. He filed an FIR about 14 hours after the alleged incident. The trial court (Judicial Magistrate, Pishin) acquitted the accused, finding the prosecution's case unconvincing. The complainant then appealed this acquittal to the Balochistan High Court.
The High Court upheld the acquittal and dismissed the appeal. It found that the 14-hour delay in filing the FIR was never explained, especially since the complainant admitted he passed by the police station right after the incident but didn't report it then. The FIR itself mentioned that it was filed only after "consultations and deliberations" with relatives, suggesting the story may have been discussed and shaped before being reported. No stolen property was recovered from the accused despite 14 days of police custody, and the complainant's witness statement included suspicious inconsistencies.
The court explained that appeals against acquittals are held to a stricter standard than appeals against convictions—an acquitted person enjoys a "double presumption of innocence," and courts should not overturn acquittals just because another view of the evidence is possible. This case illustrates how delayed FIRs and lack of recovered evidence
