Jamshed Khan v. State,

PCrLJ 2011 669 · Balochistan High Court

This case is about Jamshed Khan, who was stopped at a police checkpoint near Quetta in August 2007 while driving a car with an official-looking number plate. When signaled to stop, he sped away but was chased and caught. A search of the vehicle, conducted at the police station under the supervision of senior officers, uncovered 155 kilograms of charas (cannabis) hidden in secret compartments in the dashboard, seats, and other parts of the car. He was charged and convicted under Section 9(c) of the Control of Narcotic Substances Act, 1997, and sentenced to life imprisonment plus a fine.

On appeal, his lawyer argued that certain senior officials present during the search were not called as witnesses, and that the search should have been conducted at the checkpoint rather than after moving the vehicle to the police station.

The Balochistan High Court rejected these arguments. It held that the prosecution is not required to call every possible witness, and failing to do so does not weaken the case as long as other witnesses give consistent, credible testimony. It also ruled that conducting the search at the police station instead of the checkpoint was only a procedural irregularity, not serious enough to undermine the prosecution's case. Finding no contradictions in the evidence and no allegations of bias against the police, the court upheld the conviction and dismissed the appeal.

This case matters because it clarifies how much flexibility courts allow in narcotics prosecutions regarding witness selection and procedural technicalities, so long as the core evidence remains reliable.
