Siraj Ahmed v. The State,
PCrLJ 2011 48 · Balochistan High Court
This is an appeal decided by the Balochistan High Court against a murder conviction. Siraj Ahmed had been convicted by a trial court of killing Ghulam Muhammad and injuring Abdul Hafeez with a dagger, receiving a life sentence plus additional punishments for the attempted murder and injury charges. He appealed, claiming he was falsely implicated, that witnesses were biased relatives, and that police had pressured him into making a confession before a magistrate by threatening him with torture and falsely promising his release if he confessed.
The High Court examined the evidence closely, particularly the confession recorded under Section 164 of the Criminal Procedure Code. It held that while such confessions are strong evidence, they cannot be fully relied upon unless proven to be truly voluntary. The court found problems with the prosecution's case: the only eyewitness's account involved a motorcycle that no other witness mentioned and that was never recovered by police, undermining his claim to have clearly seen the attacker at night. The court also found the confession lacked proper corroboration from other evidence, and that the trial court had failed to properly address contradictions between witness statements and medical evidence.
Because of these unresolved doubts, the High Court ruled that the prosecution failed to prove its case beyond reasonable doubt. It accepted the appeal and acquitted Siraj Ahmed of all charges, reinforcing the principle that confessions and eyewitness testimony must be credible and corroborated before they can support a conviction.
