Karim Bakhsh v. State,

PCrLJ 2011 463 · Balochistan High Court

This case involved a devastating train accident in Balochistan on 26 September 2002, when the Quetta Express derailed near Bridge 130/B, killing eight people and injuring around 114. A government inquiry blamed several railway employees for negligence, and they were tried and convicted by a trial court under multiple laws, including murder-related provisions of the Pakistan Penal Code, causing hurt, damaging property, and endangering passenger safety under the Railways Act. They received sentences ranging up to fourteen years.

On appeal, the Balochistan High Court reviewed the evidence, including the official Railway Inspector's report, and found that while the employees were indeed negligent, there was no evidence of intent to kill or cause harm. The court ruled their actions amounted to "qatl-e-khata" (death caused by mistake or negligence, not intentional murder), reducing their conviction from murder to this lesser charge and cutting their sentence to five years. Some other charges, like causing hurt and terrorism-related offenses, were dropped for lack of evidence, though the conviction for property damage was upheld.

Importantly, the court also ruled that since individual employees couldn't be blamed alone, the Railway Department itself was responsible for compensating victims, ordering it to pay Rs. 500,000 to the families of each deceased passenger. This case matters because it clarifies the legal distinction between negligence and intentional crime, and it reinforces those public bodies like railways have a duty to compensate passengers harmed due to systemic or employee failures.
