Noor Ahmed v. State,

PCrLJ 2011 346 · Balochistan High Court

This case is about a bail application filed by Noor Ahmed, who was accused of car theft under Section 381-A of the Pakistan Penal Code. According to the police report, the complainant's Alto car was stolen from outside his house, and after being alerted by children who witnessed the theft, he and a friend chased the suspects on a motorcycle. They caught the applicant as he was entering a house, while the other accused persons escaped. Police then arrived and arrested him.

The applicant's bail request had already been rejected by both a judicial magistrate and an additional sessions judge. He then approached the Balochistan High Court, arguing that he had been in custody since his arrest, the police investigation (challan) was already complete, and the offense did not fall under the category of serious crimes that automatically bar bail.

The court noted that the stolen car was not actually recovered from the applicant's possession, and the offense carried a maximum punishment of seven years, meaning it did not fall within the restrictive provisions of Section 497 of the Criminal Procedure Code that limit bail in serious cases. The court found the case required further inquiry.

As a result, the judge confirmed the applicant's earlier interim bail, granting it permanently on the condition that he provide sureties totaling Rs. 200,000. This case illustrates how courts weigh the severity of charges and evidence when deciding whether to grant bail before trial.
