Shabbir Ahmed v. The State,

PCrLJ 2011 31 · Balochistan High Court

This case involved an appeal by Shabbir Ahmed, who was convicted and sentenced to life imprisonment plus a fine for possession of narcotics under Pakistan's Control of Narcotic Substances Act, 1997. He was apprehended along with three others during a routine checkpoint at Waricha Landhi, Balochistan, where about 19 kilograms of suspected heroin were found hidden in a vehicle he was riding in.

The appellant argued that the investigation was flawed because a Naib Risaldar, an officer below the rank required by law, conducted the seizure and recovery proceedings, and that these proceedings happened at a military fort rather than at the actual spot of recovery. He also claimed he was merely a passenger who had boarded the vehicle to collect his father's belongings and had no connection to the narcotics.

The Balochistan High Court rejected these arguments. It held that the officer had acted with proper permission from a Judicial Magistrate in the absence of his superior, so no illegality occurred. The court also ruled that procedural irregularities during investigation do not automatically invalidate a case unless they cause real prejudice to the accused, which was not shown here. Since witness testimony was consistent and the appellant's presence in the vehicle was undisputed, the burden fell on him to prove he was an innocent hitchhiker, which he failed to do.

The court upheld the trial court's guilty verdict and dismissed the appeal, reinforcing how courts evaluate procedural objections and burden of proof in narcotics cases.
