Muhammad Qasim v. State,
PCrLJ 2011 298 · Balochistan High Court
This case involved Muhammad Qasim, who was convicted by a trial court in Lasbella for causing an explosion in a public place, possessing explosives under suspicious circumstances, and keeping an unlicensed Kalashnikov rifle. He was sentenced to life imprisonment along with additional terms of rigorous imprisonment. The conviction stemmed from a nighttime police raid on a house in Jam Yousuf Colony, during which weapons, ammunition, a detonator, and other materials were allegedly recovered.
On appeal, the Balochistan High Court found serious problems with the prosecution's case. The house raided was not exclusively occupied by the appellant, since another man, Khudai Rahim, was also arrested there but was later acquitted, raising doubts about who the seized items actually belonged to. Additionally, the house belonged to a person named Qurban Ali, who was never arrested or charged. The Kalashnikov and detonator were never sent to a weapons expert for verification. Crucially, the police search violated mandatory legal requirements under Section 103 of the Criminal Procedure Code, which requires proper procedures like search warrants or independent witnesses.
Given these gaps and contradictions, the court ruled that the prosecution failed to prove its case beyond reasonable doubt. The appeal was accepted, and Muhammad Qasim was acquitted. This case highlights the importance of following proper legal procedures in searches and ensuring clear, reliable evidence before convicting someone of serious crimes.
