Mehran v. The State,

PCrLJ 2011 261 · Balochistan High Court

This case comes from the Balochistan High Court and involves an appeal by a man named Mehran, who had been convicted under the West Pakistan Arms Ordinance for possessing an unlicensed Kalashnikov rifle and live cartridges. He was sentenced to three years in prison and fined Rs.10,000.

The weapon was allegedly recovered from Mehran's house after he made a disclosure to police while in custody for a separate murder case. Police claimed he led them to his home and produced the rifle and 20 cartridges from under bedding.

On appeal, the High Court found serious problems with the prosecution's evidence. The witnesses gave contradictory accounts about the timing of events and who handled the recovered items. Most tellingly, the court discovered that the number of cartridges recorded in one witness's statement had been altered from "3" to "20" through overwriting, without any initials confirming the change was authorized. The disclosure leading to the recovery was also made on the last permissible day of police remand, raising suspicion. No independent witnesses from the neighborhood were included in the recovery process, and the house wasn't shown to be under Mehran's exclusive control.

Given these serious doubts and contradictions, the High Court ruled that the trial court had wrongly ignored inconsistencies that should have benefited the accused. The High Court overturned the conviction and acquitted Mehran, reinforcing the principle that criminal convictions require evidence free from reasonable doubt, and that altered or contradictory evidence cannot support a safe conviction.
