Khalique Dad alias Jan Agha V. The State,
PCrLJ 2011 1899 · Balochistan High Court
This case is about an appeal by Khalique Dad, alias Jan Agha, who was convicted by the Special Judge for Control of Narcotic Substances (CNS) in Quetta for possessing large quantities of narcotics, including hashish and opium, discovered at his home. He received a life sentence and a fine. Police had acted on a tip-off, raided his house without a search warrant, and found the drugs hidden in a jute sack in a room. The appellant argued he was innocent, that the drugs actually belonged to another man, and that the police violated proper search procedures by not obtaining a warrant or including independent witnesses from the neighborhood, as normally required under Section 103 of the Criminal Procedure Code.
The Balochistan High Court rejected these arguments. It held that Section 25 of the Control of Narcotic Substances Act specifically excludes the application of Section 103 Cr.P.C. in narcotics cases, meaning police don't need independent witnesses in the same way. The court also found that while Section 21 of the Act sets out search procedures, these are only directory guidelines, not mandatory requirements, so minor procedural lapses don't automatically invalidate a search. Since there was no evidence of ill will between the police and the accused, and no meaningful contradictions in witness testimony, the court upheld the conviction. This ruling clarifies that narcotics cases operate under different, more relaxed search-and-seizure rules than ordinary criminal cases in Pakistan.
