Illyas v. The State,

PCrLJ 2011 1819 · Balochistan High Court

This case involved an appeal by a man named Ilyas, who had been convicted by a trial court in Turbat for robbery causing hurt (under sections 394/34 of the Pakistan Penal Code) and sentenced to four years imprisonment plus a fine. The case arose from an incident where two men on a motorcycle allegedly snatched gold earrings from a woman, injuring her ear in the process. The complainant himself did not witness the crime; he reported it based on accounts from the victim and another woman who saw what happened. No one was named in the original police report, and Ilyas was only implicated later through an identification parade after his arrest.

The Balochistan High Court found serious problems with the evidence. The witnesses never described the physical appearance of the culprits, making the identification parade unreliable. The witness who reported the crime wasn't even present during the identification proceedings. Additionally, while police claimed Ilyas made a disclosure after arrest, no new evidence or recovery resulted from it, making that disclosure legally worthless too. The court also noted contradictions and improvements in witness statements that the trial court had failed to properly consider.

Because of these serious doubts about the prosecution's evidence, the High Court set aside the conviction and acquitted Ilyas, ordering his release. This case matters because it reinforces important legal principles: identification parades alone cannot secure convictions without corroborating details, and confessions to police only count if they lead to genuine new discoveries. It shows how courts must carefully scrutinize weak evidence before depriving someone of their liber
