Zamin Ali v. the State,

PCrLJ 2011 1756 · Balochistan High Court

This case concerns Zamin Ali and Asif Ali, who were accused of taking large sums of money from people promising to arrange jobs abroad, but the individuals sent overseas were never heard from again. A complainant, Muhammad Essa, had earlier filed a private complaint against them, resulting in their conviction and one-year sentence under sections 406 and 420 of the Pakistan Penal Code (criminal breach of trust and cheating). Separately, the FIA registered another case against the same petitioners under section 22(b) of the Emigration Ordinance, 1979, based on the same facts.

The petitioners asked the Balochistan High Court to quash this second case, arguing it amounted to punishing them twice for the same conduct. The High Court agreed. It held that under Article 13 of the Constitution, section 403 of the Criminal Procedure Code, and section 26 of the General Clauses Act, a person cannot be tried or punished twice for the same offence. Since the emigration law charge could have been included in the original trial but wasn't, it was too late to prosecute it separately now. The court also noted the petitioners had already gone through lengthy civil and criminal litigation, had reached a compromise with the complainant, and had been acquitted by the High Court on that basis, making that acquittal final.

The court quashed the pending FIA proceedings, emphasizing that reopening a closed matter would serve no purpose and would amount to abuse of legal process. This case reinforces the principle against double jeopardy in Pakistani law.
