Shams-Ullah v. State,
PCrLJ 2011 162 · Balochistan High Court
This case involved a man named Shamsullah who was convicted by a Sessions Judge in Loralai for causing explosions and attempted murder, receiving seven years imprisonment under the Explosive Substances Act and two years under Section 324 of the Pakistan Penal Code, to run concurrently. He appealed to the Balochistan High Court.
The prosecution's case was that the complainant heard three explosions outside his house at night, saw two people running away, identified the appellant using torchlight, and claimed the appellant fired a pistol at them before fleeing. Police recovered a piece of burnt wire and earth from the scene as evidence of the explosion.
The High Court found serious flaws in the prosecution's case. The burnt wire did not meet the legal definition of an explosive substance, and it was never even sent to a ballistic expert for testing. No pistol, bullets, or shell casings were recovered or tested either. Witnesses only saw the accused running away, not actually causing any explosion. Despite the incident happening in a populated area, no independent witnesses were brought forward. The court also noted a civil dispute existed between the complainant and the accused, raising the possibility of false implication, and ruled that a delayed, uncorroborated statement by the accused could not be used as evidence.
Because the prosecution failed to prove its case beyond reasonable doubt, the court overturned the conviction and acquitted Shamsullah, highlighting the importance of solid forensic evidence and independent witnesses in criminal cases.
