This case involved a father who filed a constitutional petition in the Balochistan High Court on behalf of his two sons, who had been convicted by a trial court and whose appeal had also been dismissed by the Sessions Judge. The father was not himself a party to the original criminal case against his sons. He was also upset that a Judicial Magistrate had refused to entertain his separate complaint accusing a prosecution witness of giving false evidence during the trial.
The High Court dismissed the petition, ruling it was not maintainable for two main reasons. First, to bring a constitutional petition under Article 199 of the Constitution, a person must be "aggrieved" and must have no other adequate legal remedy available. Since the father was not a party to the original case, he could not be considered an aggrieved person, and only his sons, as the actual convicts, had the right to challenge their convictions, which they could do through an ordinary appeal or revision petition, not through their father's constitutional petition.
Second, regarding the refused complaint about false testimony, the court explained that Section 195 of the Criminal Procedure Code specifically bars courts from taking up complaints about offenses like giving false evidence unless the complaint comes from the court where the alleged false statement was made, not from a private individual. So the Magistrate was legally correct in refusing it.
The case illustrates important limits on who can seek constitutional relief and how procedural bars restrict private complaints about courtroom testimony.
