Habibullah  V.  Ghulam Sarwar,

PCrLJ 2011 1490 · Balochistan High Court

This case involved an appeal against the acquittal of a man accused of involvement in a bomb explosion that killed three children in Khuzdar, Balochistan, in 2007. The complainant, the children's father, initially named three men he saw fleeing the scene but did not name the respondent, Ghulam Sarwar. Two alleged eyewitnesses later gave statements to police, four days after the incident, claiming they saw six men on two motorcycles, including the respondent, and that one of them threw an explosive device into the house. The trial court acquitted the respondent, and the complainant appealed.

The Balochistan High Court upheld the acquittal. It found the eyewitnesses' account unreliable because they had not told the complainant the respondent's name, had not helped register the police report, had not assisted with the dead or injured, and admitted they only gave their statements after discussing and coordinating with the complainant beforehand. This raised serious doubts about whether they were actually present at the scene. The court also noted that other people supposedly present at the site were never produced as witnesses, which further weakened the prosecution's case.

The court emphasized that in cases involving the death penalty, evidence must come from trustworthy sources or be backed by strong circumstances. Finding no error in the trial court's reasoning, the High Court dismissed the appeal, reaffirming the principle that convictions cannot rest on doubtful or coached testimony.

بلوچستان ہائی کورٹ نے بریت کے فیصلے کو برقرار رکھا۔ عدالت نے قرار دیا کہ عینی شاہدین کا بیان ناقابلِ اعتبار ہ
