Nadir Shah v. State,
PCrLJ 2011 1214 · Balochistan High Court
This case involved Syed Nadir Shah, who along with his three sons was accused of defrauding two men, Syed Abbas and Altaf Hussain, by promising to send them to Australia for jobs. The complainants alleged they paid 5000 US dollars each to the accused for this purpose, but were never sent abroad, and the accused failed to return the money despite repeated demands. A stamp paper and receipt were produced as evidence during the investigation. The accused was charged under the Emigration Ordinance, 1979, which deals with illegal practices in arranging foreign employment, and this offence carries a punishment of up to 14 years imprisonment.
Shah applied for bail, arguing he was innocent, elderly and in poor health, that there was unexplained delay in filing the police complaint, and that no proper documents proved he received money from the complainants. The state opposed bail, arguing the delay was properly explained, sufficient evidence linked the accused to the crime, and that people involved in human smuggling typically do not issue receipts, so the absence of such documents was not significant.
The Balochistan High Court rejected the bail application, noting that the accused was named in the police complaint, the allegations were supported by witnesses, and the case was still at a preliminary stage where evidence could not be deeply examined at the bail stage. The court also directed the trial court to conclude the case within two months. This judgment illustrates how courts weigh evidence and the seriousness of alleged fraud in foreign employment scams when deciding bail matters.
