Asimullah Vs The State,

PCrLJ 2011 1166 · Balochistan High Court

This case involved a request to cancel bail that had already been granted to several accused men in a criminal case. The complainant, Asimullah, alleged that his younger brother was attacked by a group of men, including Haji Abdul Bari and others, who caused him serious injuries during what was said to be a civil dispute. After the accused were arrested, a magistrate granted them bail. The complainant challenged this decision, first before the Additional Sessions Judge and, after that failed, before the Balochistan High Court, seeking cancellation of the bail.

The complainant argued that the accused were specifically named in the police report, were misusing their bail, had caused serious injuries, and that the magistrate had not properly heard the case before granting bail.

The High Court rejected all these arguments. It noted that the police report itself had been filed with significant, unexplained delay, raising the possibility that the accused were named only after deliberation rather than immediate identification—so naming them alone did not disqualify them from bail. There was no proof, such as a formal complaint, that the accused had misused their bail; supporting affidavits alone were not enough. The court also found that the lower courts had properly heard all parties and exercised their authority correctly.

The court held that canceling bail already granted requires strong, exceptional circumstances, which were absent here. The application to cancel bail was dismissed, reaffirming that bail once properly granted should not be lightly withdrawn.
