Muhammad Asif v. The State,
PCrLJ 2011 1076 · Balochistan High Court
This case involved a man convicted of house-breaking and theft under Pakistan's Penal Code, after being accused of stealing a carpet from a government official's residence in Naushki. A trial court and later a sessions court both found him guilty and sentenced him to imprisonment and fines. He challenged both decisions before the Balochistan High Court, arguing that the prosecution's witnesses contradicted each other and that the lower courts had wrongly relied on his own statement rather than properly weighing the prosecution's evidence.
The High Court agreed with him. It found that the man said to have reported the crime, Saadullah, had not actually witnessed the incident himself but relied on secondhand information. Key witnesses gave inconsistent accounts, and one witness who claimed to be present at the scene could not properly explain his presence there, making him a "chance witness" whose testimony required extra caution. The court held that in criminal cases, the burden always remains on the prosecution to prove guilt beyond reasonable doubt, regardless of any weaknesses in the accused's defense. Since the witnesses failed to corroborate each other convincingly, the court ruled that both lower courts had failed to properly evaluate the evidence and should have given the accused the benefit of the doubt.
As a result, the High Court overturned the conviction and acquitted the petitioner. The case reinforces the fundamental principle that suspicion or weak, contradictory evidence cannot substitute for proof beyond reasonable doubt in criminal trials.
