Muhammad Akbar & others v. The State,

PCrLJ 2011 1012 · Balochistan High Court

This case involves a bail application by three men, Muhammad Akbar, Dost Muhammad, and Amir Muhammad, who were accused of attempted murder after a shooting incident. According to the prosecution, the applicants opened fire on a complainant and his son near a mosque, and the son was hit by a bullet in his eye.

Two eyewitnesses said all three accused fired indiscriminately, but the injured victim's own statement, given later, said that only Amir Muhammad had actually fired the shot that caused his injury. The court also noted an 18-hour delay in filing the police report despite the police station being only two kilometers away, and found that although police collected bullet casings from the scene, the site plan failed to clearly show where these were found or where the accused were actually standing.

The Balochistan High Court decided that Amir Muhammad, who was specifically identified as having fired the injuring shot, did not deserve bail. However, since the allegations against the other two applicants involved only ineffective firing (meaning they did not cause the injury) and the evidence linking them to the crime was weak, their situation warranted further investigation. The court granted bail to Muhammad Akbar and Dost Muhammad, subject to providing sureties, while rejecting bail for Amir Muhammad. This case illustrates how courts distinguish between defendants based on the specific harm they are alleged to have caused, even when they are jointly accused.
