Muhammad Akram v. Muhammad Qahir,

PCrLJ 2010 666 · Balochistan High Court

This case involved a dispute between Muhammad Akram and Muhammad Qahir over a piece of land in Quetta. Akram claimed he owned the land and that Qahir, who had been his tenant, had handed over possession to him under a private settlement, after Qahir received Rs. 200,000. Akram alleged that Qahir later illegally re-entered and occupied the land, so he filed a complaint under the Illegal Dispossession Act, 2005. The trial court dismissed the complaint and acquitted Qahir, saying there was no direct evidence that Qahir had actually given up possession.

Meanwhile, a related civil suit filed by Qahir over the same property had been decided against him at every level, including the High Court and the Supreme Court, all of which found that possession had indeed been transferred to Akram and that Qahir's reoccupation was illegal.

The Balochistan High Court held that the trial court had ignored these consistent civil court findings and the substantial oral evidence (ten witnesses) presented by Akram, amounting to misappreciation of evidence. It set aside the acquittal, convicted Qahir under Section 3 of the Illegal Dispossession Act, sentenced him to one year's imprisonment plus a fine, and ordered police to restore possession of the land to Akram within a week.

The case matters because it shows courts using prior civil litigation outcomes to inform criminal proceedings on illegal dispossession, and it reinforces protection against forcible land-grabbing after lawful settlements.
