Hassan v. State,
PCrLJ 2010 1326 · Balochistan High Court
This case involved Haji Hassan and his son, who were convicted by a Sessions Judge in Zhob for the murder of Hassan's wife, Mst. Zar Bakhat, and sentenced to life imprisonment. The prosecution's case was based on a First Information Report lodged by the victim's brother, who was not present at the time of the killing and only learned about it afterward. The evidence against the accused included an alleged extra-judicial confession by one appellant, recoveries of a rifle, magazine, and knife made during police custody, and reports from forensic and firearm experts.
On appeal, the Balochistan High Court examined the evidence closely and found serious weaknesses in the prosecution's case. Neither the complainant nor other key witnesses had actually seen the crime take place. The extra-judicial confession was considered weak evidence, and in this case it lacked independent corroboration. The circumstantial evidence presented did not form a complete, connected chain proving guilt, and the prosecution's evidence was inconsistent in various respects. While it was undisputed that the death was unnatural, this alone was not enough to establish guilt.
Because the prosecution failed to prove its case beyond reasonable doubt, the High Court set aside the conviction and acquitted both appellants, ordering their release. This case illustrates the important legal principle that convictions, especially for serious offenses like murder, cannot rest on suspicion, weak confessions, or incomplete circumstantial evidence—guilt must be established with proof beyond reasonable doubt.
