Abdul Ghaffar v. the State,
PCrLJ 2010 1204 · Balochistan High Court
This case involved Abdul Ghaffar, who was convicted by an Additional Sessions Judge in Quetta for possessing an unlicensed TT pistol and three live cartridges, an offence under the West Pakistan Arms Ordinance, 1965. He was sentenced to three years imprisonment plus a fine, with additional imprisonment if the fine went unpaid.
Ghaffar appealed to the Balochistan High Court, but his lawyer did not contest the conviction itself. Instead, he asked the court to reduce the sentence, arguing that the trial court had been one-sided in weighing the evidence and ignored contradictions favorable to the accused.
The High Court noted that although this argument was raised, no specific contradictions were actually pointed out to support it. More importantly, the court observed that the weapon recovered from Ghaffar appeared to be linked to two other serious pending cases against him, one for robbery (Haraabah) and another for attempted murder and using criminal force against police officers. Since there was no evidence that he had been acquitted in those cases, the court found no justification for leniency.
Relying on Section 423(1)(b) of the Criminal Procedure Code, which allows an appellate court to reduce a sentence without disturbing the trial court's findings, the judge decided there was no valid basis to do so here. The appeal was dismissed, and the original conviction and sentence were upheld.
