Abdul Wali v. The State,

PCrLJ 2010 1182 · Balochistan High Court

This case involved a robbery that occurred at a home in Quetta in September 2007, where armed men broke in, assaulted the complainant, and stole cash, bonds, and jewelry. The complainant reported the crime the same day but could not name the attackers, saying only that he might recognize two of them since their faces briefly became visible during the struggle.

More than a year later, the complainant spotted one of the alleged robbers, Abdul Wali, at a bus stand and had him arrested. Wali was tried and convicted under Section 392 of the Pakistan Penal Code for robbery, receiving seven years' imprisonment plus a fine.

On appeal, Wali argued that he was wrongly convicted because no formal identification parade was conducted after his arrest, and that the trial court had misread or ignored evidence in his favor.

The Balochistan High Court rejected these arguments. It held that since the accused was arrested directly on the complainant's own identification at the bus stand, a formal identification parade was unnecessary. The court also noted that three eyewitnesses had identified Wali as one of the culprits, with no significant contradictions in their testimony, and that the defense had not shown any specific evidence that was overlooked or misused by the trial court.

The appeal was dismissed, and the conviction upheld. The case illustrates how courts assess eyewitness identification and when procedural steps like identification parades are considered necessary.
