Khayal Muhammad v. State,
PCrLJ 2010 1145 · Balochistan High Court
This case concerns the confiscation of a Mazda truck used to smuggle 290 kilograms of charas (a narcotic substance) in Balochistan. In 2007, Coast Guard officials intercepted the truck and found the drugs, leading to charges against two men, who were later convicted and sentenced to 14 years imprisonment each. The trial court also ordered the truck confiscated by the state.
Khayal Muhammad, claiming to be the truck's owner, appealed against the confiscation order. He argued that he had never been properly notified or given a chance to contest why his vehicle should not be confiscated.
The Balochistan High Court agreed with him. It held that under the Control of Narcotic Substances Act, 1997, a vehicle can only be confiscated if it is proven that the owner knew the offence was being or was about to be committed. This knowledge, the court explained, is a factual matter that must be determined through proper legal process, which requires notifying the owner and giving them an opportunity to be heard. In this case, the trial court had failed to follow this procedure entirely and confiscated the vehicle without any inquiry into the owner's knowledge.
As a result, the High Court set aside the confiscation order and sent the matter back to the trial court to be decided properly, in accordance with the law. This case matters because it reinforces that property owners have a right to due process before losing their assets, even in serious narcotics cases.
