Fateh Muhammad v. State,
PCrLJ 2010 1082 · Balochistan High Court
This case is about Fateh Muhammad, who was caught with a suspected smuggled vehicle in Quetta in 2003. He was tried and convicted by a Special Customs Judge under the Customs Act for possessing smuggled goods, sentenced to two years in prison plus a fine, with the vehicle confiscated. Separately, he had also been named in the same FIR for offences of forgery and using forged documents under the Pakistan Penal Code. On appeal to the Balochistan High Court, his lawyer argued that being prosecuted twice from the same FIR violated the constitutional protection against double jeopardy (Article 13(a)) and Section 403 of the Criminal Procedure Code, which bars a second trial for the same offence.
The High Court rejected this argument. It explained that double jeopardy only applies when the offence being tried a second time is identical to the first. Here, the Customs Act offence (possessing smuggled goods) and the Penal Code offences (forgery and using forged documents) are legally distinct, even though they arose from the same set of facts and same FIR. Since they are different offences, they can be tried separately in different courts without breaching the law.
However, the court did show leniency on sentencing: since the appellant had already suffered the hardships of trial since his 2003 arrest and had no history of prior smuggling offences, his sentence was reduced to time already served. The case clarifies that facing multiple prosecutions from one incident is lawful when the charges involve genuinely separate offences under different statutes.
