Adalat Khan v. State,
PCrLJ 2010 1042 · Balochistan High Court
This case involved two men, a driver and a cleaner of a truck, who were caught transporting 290 kilograms of hashish hidden inside onion bags on a highway in Balochistan. Coast guards, acting on secret information, stopped the vehicle and discovered the drugs concealed in ten bags. The men were arrested, tried under the Control of Narcotic Substances Act, 1997, and convicted by a Special Judge, receiving 14 years imprisonment each along with fines.
On appeal, their lawyer argued that the two were merely hired transport workers who had no knowledge that hashish was hidden in the onion bags they were carrying, and that the real culprits who arranged the shipment had already been acquitted by the trial court.
The Balochistan High Court rejected this argument. It found the prosecution witnesses credible and consistent, with only minor, natural discrepancies in their testimony. Importantly, the court explained that once possession of narcotics is not disputed, the law places a burden on the accused under Section 29 of the Act to prove their innocence with solid evidence, not just deny the charge. Since the appellants offered no evidence to support their claim of innocence, merely asserting they were unaware of the drugs, they failed to meet this legal burden. The court therefore upheld their conviction and sentence.
This case illustrates how narcotics law in Pakistan shifts the burden of proof onto the accused once possession is established, making a simple denial insufficient for acquittal.
