PCr.LJ 2025 974 · Balochistan High Court
This case involved a request to transfer a murder trial from one court to another. The applicant, involved in an FIR registered under section 302 of the Pakistan Penal Code (murder), asked the Balochistan High Court to move the case away from the Sessions Judge, Kalat, claiming that the judge was biased against him.
The High Court rejected this request. It explained that bias can take different forms, such as a judge having a personal stake in the case, a financial interest, or personal hostility toward a party. However, simply alleging bias is not enough, there must be solid, trustworthy evidence showing a real likelihood that the judge's conduct would unfairly affect the outcome of the trial. The court noted that the applicant's claim rested only on an alleged remark by the opposing side that they would receive favorable treatment from the court, something the judge said did not amount to proof of actual bias.
Since no concrete evidence was provided and the allegations were vague, the court dismissed the application outright, meaning it was rejected without even going into a detailed hearing of the merits.
This ruling reinforces an important principle: courts cannot be casually transferred just because a party feels suspicious or uneasy. Doing so would undermine judicial stability and allow parties to manipulate the system through baseless complaints. Genuine evidence of bias is required before such a serious step is taken.
