Muhammad Naeem V. The State,
PCr.LJ 2025 732 · Balochistan High Court
This case involved Muhammad Naeem, who was convicted by a Special Judge in Turbat for possessing 2000 grams of charas (hashish), a crime under Section 9(c) of the Control of Narcotic Substances Act, 1997. He was sentenced to two years rigorous imprisonment and a fine of Rs.10,000. He appealed to the Balochistan High Court.
The prosecution's case was that police apprehended Naeem on suspicion and found two packets of charas, weighing 1000 grams each, in a plastic bag he was carrying. Five witnesses, including the arresting officer and lab personnel, testified consistently about the arrest, recovery, and chain of custody of the evidence.
The defense argued that only police officials witnessed the recovery, with no independent civilians present, which they claimed violated procedural law. The court rejected this argument, noting that narcotics cases are specifically exempted from the requirement to involve private witnesses, and that ordinary citizens are often reluctant to get involved in such cases. Since there was no evidence of enmity between the police witnesses and the appellant, their testimony was considered reliable.
The court also confirmed that the recovered samples were sent to the forensic lab within the legally required timeframe and tested positive for hashish, with no signs of tampering.
Finding the prosecution's evidence consistent and credible, the High Court dismissed the appeal and upheld the conviction. This case reaffirms that police testimony alone can be sufficient to convict in narcotics cases, provided it is
