This case involved a mining dispute in Balochistan. In 2007, the petitioner company, M/s. Sino Pak Minerals, was granted a 30-year mining lease over land in Killa Saifullah after another company, M/s. Bagh Metals, had voluntarily surrendered its rights in the petitioner's favor. The petitioner invested heavily in infrastructure and began mining operations, though these were disrupted by an armed takeover of the site and later by the deaths of foreign staff and the departure of the company's managing director due to a family medical emergency.
In 2012, the government mining authority sent the petitioner a notice asking for quarterly progress reports, and later cancelled the company's mining lease altogether, citing an idle mining area, no production, and failure to submit the required reports. The petitioner argued it never actually received these notices and was therefore never given a chance to respond or defend itself before its lease was cancelled. An appeal to the government was rejected, and a rival claimant, M/s. Bagh Metals, sought to be added as a party, arguing it should get the lease back.
The Balochistan High Court found that the notices had not been properly and verifiably served on the petitioner. Since the company was never given a genuine opportunity to be heard, the cancellation violated basic fairness requirements. The court therefore ruled that the cancellation orders were void from the outset. This case underscores that government authorities must properly notify affected parties and provide a fair hearing before revoking valuable rights like mining leases.
