Noor Jan and 5 others V. The State,
MLD 2024 858 · Balochistan High Court
This case is about a bail application in a murder case from Balochistan. Six people (Noor Jan and five others) were accused of firing on and killing a man named Nawab Khan in his field. The deceased's mother filed a police report naming eight accused persons and unidentified others, alleging they all fired on her son. The accused had been denied bail by the trial court and approached the High Court seeking release on post-arrest bail.
The High Court granted bail. It found several weaknesses in the prosecution's case: there was a two-and-a-half-hour delay in reporting the incident despite the police station being only 12 kilometres away, suggesting the complainant may have had time to deliberate or consult others before naming suspects. The FIR vaguely described the incident without specifying which accused caused which injury, and did not even identify the weapons used. Although eight people were accused of firing, the victim had only one gunshot wound, and no witnesses were injured despite the open setting of the alleged attack. The court also noted that another person had filed a competing report about the same incident, resulting in two separate police challans (charge sheets) reflecting conflicting versions of events. No weapons were recovered from the accused during investigation.
Given these inconsistencies, the court held that the case fell under the provision allowing bail due to doubtful evidence, and granted the accused post-arrest bail.
