Mir Wais V. Naseebullah and 3 others,

MLD 2024 462 · Balochistan High Court

This case comes from the Balochistan High Court and deals with how police complaints are handled when someone approaches a Justice of Peace to get a criminal case registered against another person.

The petitioner, Mir Wais, had an FIR registered against him under injury-causing provisions of law, and separately was arrested in a narcotics case involving a vehicle with two different number plates. The complainant in the original injury case then filed an application asking a Justice of Peace (an Additional Sessions Judge acting in that capacity) to direct police to register a further criminal case against the petitioner. The Justice of Peace accepted this request and ordered registration of the case without giving detailed reasons.

The petitioner challenged this order, arguing it was issued mechanically and was intended merely to harass him.

The High Court agreed. It held that a Justice of Peace must not act as a rubber stamp by simply accepting one party's version of events. Instead, the judge must genuinely examine whether there is actual supporting material before directing registration of a case, since such proceedings are quasi-judicial, not routine administrative acts. Relying on earlier Supreme Court guidance, the Court found the complaint here appeared aimed at harassing the petitioner rather than seeking genuine justice, showing mala fide intent. It therefore set aside the Justice of Peace's order and allowed the petition.

The case highlights safeguards against misuse of police-complaint powers to settle personal scores through criminal proceedings.
