This case was heard by the Balochistan High Court after a law graduate, Basit Ali, challenged the way the Higher Education Commission (HEC) selected candidates for a foreign scholarship program for LLM studies. The petitioner had taken HEC's scholarship test twice, in 2021 and 2022, but was not selected either time. He argued that the eligibility criteria, which combined test scores with academic credentials like LLB grades, unfairly disadvantaged graduates from the University of Punjab, Lahore, because that university's grading system resulted in lower scores compared to other institutions. He asked the court to direct HEC to prepare the merit list based solely on test scores rather than academic credentials.
The court dismissed the petition. It found that the petitioner had voluntarily participated in the HEC test under the known criteria, and only complained after failing to secure a scholarship. Applying the legal principle of estoppel, the court held that someone who willingly takes part in a selection process cannot later challenge its fairness simply because they did not succeed. The court also emphasized that courts should not interfere in policy and technical decisions made by expert bodies like HEC unless there is clear evidence of bad faith or illegality, which was absent here. The judgment reinforces that educational institutions have discretion to set evaluation criteria, and dissatisfaction with results alone is not grounds for judicial intervention.
