This case involved a long-running dispute over a shop in Quetta originally allotted by the Evacuee Trust Property Board. The petitioner's father had occupied the shop for decades, while the predecessor of the private respondents claimed to be the registered tenant. Over the years, both sides went through multiple rounds of civil litigation. The private respondents' earlier suit for possession was dismissed, and that decision became final after being upheld through appeal and a constitutional petition. Later, the petitioner himself filed a civil suit seeking a declaration of title and an order directing authorities to issue the rent receipt in his name. That suit was initially partly decreed in his favor, but on appeal, the Additional District Judge reversed the decision and dismissed the petitioner's suit entirely.
Months later, after officials locked the shop and issued an eviction notice, the petitioner approached the High Court under Article 199 of the Constitution, asking it to declare the locking unlawful and to direct authorities to act on his pending applications, including transferring the rent receipt to his name.
The High Court dismissed the petition. It held that since the petitioner's claim to title had already been rejected by the civil courts, he was effectively trying to relitigate a settled matter through writ jurisdiction. The court emphasized that constitutional relief is equitable in nature, available only to those who approach with clean hands, and cannot be used to achieve what courts have already denied. This case reinforces that writ jurisdiction cannot override final civil court findings or assist litigants seeking unjust outcomes.
