Murtaza V. The State,

MLD 2024 1172 · Balochistan High Court

This case involves Murtaza, who was convicted by a trial court in Balochistan and sentenced to life imprisonment plus a fine for allegedly possessing 26 kilograms of charas (hashish), an offence under the Control of Narcotic Substances Act, 1997. The drugs were supposedly found hidden in his car during a checkpoint search.

On appeal, the Balochistan High Court overturned the conviction and acquitted him, citing serious flaws in the prosecution's case. First, the chain of custody for the drug samples was not proven: the police official responsible for storing evidence (the Moharrar) was never produced or questioned, and there was an unexplained three-day gap between the recovery of the drugs and when the samples reached the laboratory, raising the possibility of tampering. Second, there was an unexplained five-hour delay in filing the police report (FIR), which the court said increases the risk of false implication and requires a credible explanation that the prosecution failed to provide. Third, the witnesses gave contradictory accounts about key details, such as exactly where in the car the drugs were found, who searched the vehicle, and what time they arrived at the scene.

Because of these unexplained gaps and inconsistencies, the court held that the prosecution failed to prove guilt beyond reasonable doubt, and the appellant deserved the benefit of the doubt. This case illustrates how strict evidentiary standards, especially around evidence handling and witness consistency, are essential to prevent wrongful convictions in narcotics cases.
