Muhammad Ameen V. Deputy Commissioner Panjgur,

MLD 2023 910 · Balochistan High Court

This case involved a man, Muhammad Ameen, whose land was partly taken by the government for a road construction project in Panjgur, Balochistan. He had already received compensation for date palm trees located on the affected land, but he wanted additional compensation for about 700 square feet of actual land that was absorbed into the road. When the Deputy Commissioner's office failed to decide his compensation application, he approached the Balochistan High Court directly under Article 199 of the Constitution, asking the court to order the authorities to process his claim and pay him.

The court dismissed the petition. The key problem was that Ameen could not prove he actually owned the land. He never produced any title documents, and when given a chance to submit evidence, he only provided an old court judgment from a dispute between other parties, which did not establish his ownership. The government's lawyer confirmed the land was officially government property.

The court explained that its special constitutional powers can only be used when someone's legal right is completely clear and beyond doubt. Since ownership here was disputed and unproven, the matter required a full civil trial with evidence, not a quick constitutional petition. This case illustrates an important principle: courts will not use their extraordinary writ jurisdiction to resolve property ownership disputes that need detailed factual investigation—such claims must go through ordinary civil courts instead.
