Mehtab alias Methoo V. The State,
MLD 2023 327 · Balochistan High Court
This case involves Mehtab, also known as Methoo, who was accused of breaking into a house at night and stealing two mobile phones. He was convicted by a trial court based on his own guilty plea and sentenced to several years in prison, a sentence later upheld on appeal. The matter reached the Balochistan High Court through a jail petition.
The High Court found serious problems with how the case was handled. First, the trial court had earlier suspected the accused might be mentally ill and had asked the jail superintendent for a medical report, but no report ever came back, and the court went ahead with the trial anyway, never resolving the question of his mental fitness to stand trial. Second, the accused had no lawyer, and the court never properly checked whether he wanted one or ensured he received required case documents before recording his guilty plea. Third, the formal charge against him was incomplete and failed to include key legal elements of the offense, and there was no eyewitness or identification parade linking him to the crime beyond recovered phones.
Because of these failures, the High Court ruled that the conviction could not stand. It set aside the judgment and sent the case back to the trial court, instructing it to first determine whether the accused was mentally fit to defend himself before proceeding further. This case highlights the importance of protecting the rights of potentially mentally ill defendants and following proper legal procedure before convicting someone, even on a guilty plea.
