Dr. Muhammad Akbar V. Mst. Safia Kakar and 9 others,

MLD 2023 24 · Balochistan High Court

This case arose from a family property dispute in Balochistan. A man had married twice; his children from both marriages, along with other relatives, became entangled in a lawsuit over inherited property after his death in 1991. The plaintiffs (children from the second wife) sued for declaration, partition of property, mesne profits (compensation for use of property), and a permanent injunction, targeting a doctor (the petitioner, also from the second wife) and other relatives. The disputed property included over 200 acres of agricultural land in Pishin, allegedly in the possession of children from the first wife, as well as a separate plot later sold to outside buyers.

During trial, the judge ordered that the children of the first wife and the buyers of the sold land be added as defendants, since the case involved property claims affecting them too. The doctor challenged this, arguing a 1996 family settlement had already divided the properties, so these people had no stake in the case.

The Balochistan High Court disagreed. It held that since the plaintiffs sought partition of the Pishin property, the first wife's children were "necessary parties" without whom the court could not grant an effective, complete decision. Citing Supreme Court precedent, the court ruled that although technically a case cannot be thrown out merely for missing parties, if a truly necessary party is left out, the suit cannot succeed until they are included. The petition was dismissed, upholding the trial court's order to add these parties.

مقدمے کی سماعت کے دوران جج نے حکم دیا کہ پہلی بیوی کی اولاد اور فروخت شدہ زمین کے خریداروں کو بھی مد
