Muhammad Rafique V. The State,

MLD 2023 1528 · Balochistan High Court

This case concerns a bail application in a murder case registered in Noshki, Balochistan. According to the First Information Report, the complainant's brother was shot and killed by a co-accused, Kaleemullah, who fired a pistol inside a shop. The applicant, Muhammad Rafiq, was also named in the FIR as having arrived at the scene with Kaleemullah on a motorcycle, but no act of firing was attributed to him. His earlier bail request had been rejected by the Sessions Judge, prompting this application before the Balochistan High Court.

The High Court granted bail, reasoning that mere presence at a crime scene is not enough to establish guilt unless the prosecution shows the accused shared a common intention with the actual shooter or helped him in some way. The FIR did not even clarify whether the applicant was armed or empty-handed, and the co-accused's confession named a different person as being with him, not the applicant. The weapon was recovered based on the co-accused's disclosure, not the applicant's.

The court held that since no specific role was attributed to the applicant, his case required "further inquiry," a recognized ground for bail. It emphasized that even if trial proceedings have begun, courts retain power to grant bail where warranted, and wrongful detention of an innocent person cannot later be compensated. Bail was granted upon furnishing sureties worth Rs. 500,000.
