Sanaullah V. Station House Officer Police Station Nushki and 3 others ,
MLD 2022 990 · Balochistan High Court
This case involved a property dispute between the petitioner, Sanaullah, and some private respondents. Sanaullah claimed the respondents were interfering with his property, threatening him, and had damaged his motorcycle, even though a civil court had already ordered the parties to maintain the status quo. When police took no action on his complaint, he approached the Ex-Officio Justice of Peace (the Sessions Judge) under section 22-A of the Criminal Procedure Code, asking for police action. The Sessions Judge directed the police officer (SHO) to place the complaint before a Judicial Magistrate rather than ordering registration of a criminal case (FIR). Sanaullah challenged this direction before the High Court.
The High Court upheld the Sessions Judge's order and dismissed the petition. It explained that the alleged offences, causing damage to property and intentional insult to provoke a breach of peace, are classified as non-cognizable offences under the law. For such offences, police cannot automatically investigate or register a case; instead, under section 155 of the Criminal Procedure Code, they must record the complaint in the police diary and refer the complainant to a Magistrate, who alone can authorize investigation or arrest.
This judgment matters because it clarifies the distinction between cognizable and non-cognizable offences and confirms that for minor offences like property damage or verbal insults, citizens must seek permission from a Magistrate rather than expecting direct police investigation.
