Ali Ahmed and 2 others V. Ghulam Mustafa and others ,

MLD 2022 908 · Balochistan High Court

This case was about a request to transfer a civil lawsuit from one court to another. The petitioners, Ali Ahmed and two others, had filed an ejectment suit against Ghulam Mustafa and others before a civil court in Pishin. While that case was ongoing, they asked for it to be moved to a different court, claiming the presiding judge was biased against them. Their main evidence was that the opposing side had allegedly said they would get favorable treatment from the court. The District Judge rejected this transfer request, and the petitioners challenged that rejection before the Balochistan High Court.

The High Court upheld the decision to deny the transfer. It explained that bias can take different forms, such as a judge having a personal stake in the case, a financial interest, or personal hostility toward a party. However, simply alleging that someone claimed to have influence with the court, without any solid evidence or actual conduct by the judge showing unfairness, is not enough. The court stressed that mere suspicion or apprehension cannot substitute for real proof, and cases should not be transferred routinely or based on a party's personal whims.

This ruling matters because it reinforces an important safeguard for the justice system: confidence in courts requires that transfer requests be based on genuine, demonstrable grounds like proven bias or financial interest, not vague fears or unverified claims, which helps prevent misuse of the transfer process to delay or manipulate proceedings.
