Abdul Bari V. Akhtar Rasheed, Station House Officer, Police Station Airport, Quetta and 5 others ,

MLD 2022 805 · Balochistan High Court

This case is about a man, Abdul Bari, who sued a police station house officer and five others, claiming they had defamed him by circulating a false police report, and sought Rs. 1,20,00,000 in damages. The trial court dismissed his suit at the outset by accepting the defendants' application under Order VII, Rule 11 of the Civil Procedure Code, which allows rejection of a plaint (the initial complaint) without a full trial if it discloses no valid cause of action. Abdul Bari appealed this dismissal to the Balochistan High Court.

The High Court upheld the trial court's decision. It found that his plaint was vague and failed to specify what defamatory words or actions caused him harm, when the harm occurred, how financial loss was calculated, or before whom his reputation was damaged. The court also noted he had not properly followed procedural rules requiring clear, detailed pleadings. Additionally, since he sent a legal notice more than eleven months after the alleged defamation, his claim was time-barred under the Defamation Ordinance, 2002, which sets a strict six-month limitation period for such suits—separate from the general Limitation Act.

The appeal was dismissed. This case matters because it clarifies that defamation suits require precise, detailed allegations and strict compliance with filing deadlines; vague claims and procedural delays can result in dismissal before the case is even examined on its merits.
